The EEOC announced that:
“…the unproven utility to its enforcement program of the pay data as defined in the 2016 Component 2 [pay information broken down by job category, race, sex and ethnicity] is far outweighed by the burden imposed on employers that must comply with the reporting obligation. Therefore, the EEOC is not seeking to renew Component 2 of the EEO-1.”
Component 2 data for 2017 and 2018 still must be submitted by September 30, 2019 and courts might intervene to compel the EEOC to gather the data in future years despite this announcement.
